The Rome I Regulation on the law applicable to contractual obligations can play a key role in cross-border insolvency and restructuring proceedings. The paper outlines the reasons why the Regulation holds significant importance, concluding with suggestions on how to strengthen the recognition of out-of-court agreements in a hypothetical future recast of the European Insolvency Regulation.
